{"id":10839,"date":"2021-04-22T13:09:33","date_gmt":"2021-04-22T11:09:33","guid":{"rendered":"https:\/\/reclaimfinance.org\/site\/?p=10839"},"modified":"2023-02-14T18:07:58","modified_gmt":"2023-02-14T17:07:58","slug":"the-eu-sustainable-taxonomy-set-to-fuel-greenwashing","status":"publish","type":"post","link":"https:\/\/reclaimfinance.org\/site\/en\/2021\/04\/22\/the-eu-sustainable-taxonomy-set-to-fuel-greenwashing\/","title":{"rendered":"The EU Sustainable Taxonomy set to fuel greenwashing"},"content":{"rendered":"<p><div class=\"fusion-fullwidth fullwidth-box fusion-builder-row-1 nonhundred-percent-fullwidth non-hundred-percent-height-scrolling\" style=\"--awb-border-radius-top-left:0px;--awb-border-radius-top-right:0px;--awb-border-radius-bottom-right:0px;--awb-border-radius-bottom-left:0px;--awb-flex-wrap:wrap;\" ><div class=\"fusion-builder-row fusion-row\"><div class=\"fusion-layout-column fusion_builder_column fusion-builder-column-0 fusion_builder_column_1_1 1_1 fusion-one-full fusion-column-first fusion-column-last\" style=\"--awb-bg-size:cover;--awb-margin-bottom:0px;\"><div class=\"fusion-column-wrapper fusion-flex-column-wrapper-legacy\"><div class=\"fusion-text fusion-text-1\"><div align=\"justify\">\n<p align=\"justify\"><b style=\"color: #8ac56b;\">On April 21st, 2021, the EU Commission published <\/b><b><span style=\"color: #8ac56b;\"><u><a style=\"color: #8ac56b;\" href=\"https:\/\/ec.europa.eu\/finance\/docs\/level-2-measures\/taxonomy-regulation-delegated-act-2021-2800_en.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">the delegated acts<\/a><\/u><\/span><\/b><b style=\"color: #8ac56b;\"> (1) of the EU sustainable taxonomy for climate mitigation and adaptation. While the technical work on the EU taxonomy started in 2018, the energy-related content of the delegated acts has been reshaped by tremendous pressure from Member states and industry lobbies. The end result: the EU Taxonomy opens the door to polluting activities and allows the greenwashing it was supposed to prevent. Now, it is up to the European Parliament and European Council to reject this proposal that could sink the whole EU Sustainable Finance Strategy.<\/b><\/p>\n<p align=\"justify\"><b style=\"color: #59bc6d;\">More politics, less science <\/b><\/p>\n<p align=\"justify\">The Commission <u><a href=\"https:\/\/ec.europa.eu\/commission\/presscorner\/detail\/en\/qanda_21_1805\" target=\"_blank\" rel=\"noopener noreferrer\">insists<\/a><\/u> that its work is based \u201con robust, science-based, technical criteria\u201d but adds that \u201cat the same time, these criteria must be usable by market participants and acceptable to the co-legislators\u201d. <b>Meaning: the Taxonomy was initially defined as a science-based list but economic and political pressures pushed the Commission to water down the science. <\/b><\/p>\n<p align=\"justify\">The work on the EU Taxonomy began in July 2018, with the creation of the Technical Expert Group (TEG) that was charged to define technical criteria. In March 2020, the TEG released its <a href=\"https:\/\/ec.europa.eu\/info\/sites\/info\/files\/business_economy_euro\/banking_and_finance\/documents\/200309-sustainable-finance-teg-final-report-taxonomy_en.pdf\"><u>final report<\/u><\/a> that \u2013 though it was far from perfect and already missed the mark on bioenergy \u2013 set out some strong requirements, notably by excluding fossil gas and nuclear from the regulation.<\/p>\n<p align=\"justify\"><b>While the TEG\u2019s final report should have been used as a minimum standard by the Commission, it became the starting point of <u><a href=\"https:\/\/www.politico.eu\/wp-content\/uploads\/2020\/12\/14\/IM_Taxonomy_Industry_Lobbying_Dec2020_final.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">intense behind-door bargaining<\/a><\/u>.<\/b> Energy companies, their interest groups and Member states all pushed to see their favorite energy source branded as sustainable. <b>Despite the taxonomy being only <u><a href=\"https:\/\/www.politico.eu\/wp-content\/uploads\/2020\/12\/14\/IM_Taxonomy_Industry_Lobbying_Dec2020_final.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">a transparency tool<\/a><\/u>, lobbyist from highly polluting sectors <u><a href=\"https:\/\/www.euractiv.com\/section\/energy-environment\/opinion\/eu-taxonomy-for-sustainable-activities-a-means-to-an-end-that-risks-being-the-end-of-many-european-industries\/\" target=\"_blank\" rel=\"noopener noreferrer\">painted it<\/a><\/u> as the gravedigger of European industries. <\/b><\/p>\n<p align=\"justify\">The EU Commission did not resist this pressure for long.<b> It delayed the publication of the delegated acts <u><a href=\"https:\/\/www.euractiv.com\/section\/energy-environment\/news\/brussels-postponed-green-finance-rules-after-10-eu-states-wielded-veto\/\" target=\"_blank\" rel=\"noopener noreferrer\">several times<\/a><\/u> and made a series of dangerous concessions revealed in various leaks<\/b>. The result of this opaque process is a text that fails to establish truly <u><a href=\"https:\/\/www.euractiv.com\/section\/energy-environment\/news\/eu-chief-adviser-says-credibility-of-green-finance-rules-at-risk\/\" target=\"_blank\" rel=\"noopener noreferrer\">science-based<\/a><\/u> sustainable criteria and even turns to greenwashing with extremely low bioenergy requirements and both fossil gas and nuclear in the waiting room.<\/p>\n<\/div>\n<p style=\"color: #59bc6d;\" align=\"justify\"><b>Green light for unsustainable forest burning<\/b><\/p>\n<p align=\"justify\">Instead of tightening the initial recommendations of the TEG to ensure that bioenergy and forestry criteria would contribute to reforestation and sustainable biomass use, the Commission continuously weakened them. Concretely, <b>all forest biomass &#8211; wood sourced directly from forests &#8211; may be burned as feedstocks and almost any activity that is aligned with the <u><a href=\"https:\/\/www.nature.com\/articles\/s41467-018-06175-4\" target=\"_blank\" rel=\"noopener noreferrer\">flawed<\/a><\/u> Renewable Energy Directive (RED) will be counted as sustainable <\/b>(including dedicated cropland).<\/p>\n<p align=\"justify\"><b>This contradicts all authoritative <u><a href=\"https:\/\/reclaimfinance.org\/site\/en\/2020\/12\/03\/funding-coal-conversion-to-biomass-is-it-a-green-idea\/\" target=\"_blank\" rel=\"noopener noreferrer\">scientific research<\/a><\/u>, the Commission\u2019s <u><a href=\"https:\/\/eur-lex.europa.eu\/resource.html?uri=cellar:1bdc63bd-b7e9-11e6-9e3c-01aa75ed71a1.0001.02\/DOC_1&amp;format=PDF\" target=\"_blank\" rel=\"noopener noreferrer\">own impact assessment<\/a><\/u> on bioenergy <\/b>and a call from <u><a href=\"https:\/\/www.euractiv.com\/wp-content\/uploads\/sites\/2\/2018\/01\/Letter-of-Scientists-on-Use-of-Forest-Biomass-for-Bioenergy-January-12-2018.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">major scientists<\/a><\/u> to stop considering bioenergy as a sustainable replacement for fossil fuel. As they stand in the Commission\u2019s delegated acts, the criteria for bioenergy will contribute to deforestation in Europe to accommodate the wishes of the <u><a href=\"https:\/\/www.politico.eu\/wp-content\/uploads\/2020\/12\/14\/IM_Taxonomy_Industry_Lobbying_Dec2020_final.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">forest and energy industry<\/a><\/u> and <u><a href=\"https:\/\/www.euractiv.com\/section\/energy-environment\/news\/leak-eu-taxonomy-draft-leaves-bioenergy-and-forestry-off-the-hook\/\" target=\"_blank\" rel=\"noopener noreferrer\">Scandinavian countries<\/a><\/u>.<\/p>\n<p align=\"justify\"><b style=\"color: #59bc6d;\">Fossil gas already in? <\/b><\/p>\n<p align=\"justify\">Amid contradictory pressure from Member States and strong corporate lobbying, the published delegated acts do not settle the gas and nuclear debate. <b>While the Commission recently contemplated including some gas plants (2), it finally decided to postpone. The fate of gas, nuclear and so-called \u201ctransition activities\u201d will be decided later in a <u><a href=\"https:\/\/ec.europa.eu\/finance\/docs\/law\/210421-sustainable-finance-communication_en.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">complementary delegated act<\/a><\/u>. <\/b><\/p>\n<p align=\"justify\">The inclusion of gas to the Taxonomy as long been a priority for strong industry lobbies with companies &#8211; like <u><a href=\"https:\/\/www.rfi.fr\/en\/business-and-tech\/20210420-bp-lobbying-to-weaken-eu-green-investment-watchdog\" target=\"_blank\" rel=\"noopener noreferrer\">BP<\/a><\/u> &#8211; wielding considerable influence in Brussel. The <u><a href=\"https:\/\/reclaimfinance.org\/site\/wp-content\/uploads\/2020\/08\/Reclaim-Finance-Media-Briefing-EU-Sustainable-Taxonomy-1.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">gas lobby<\/a><\/u> can count on 759 employees and spends between \u20ac68.8 million and \u20ac82.9 million each year to weigh in EU legislation.<b> Despite gas being <u><a href=\"https:\/\/globalenergymonitor.org\/wp-content\/uploads\/2021\/03\/GEM-Europe-Gas-Tracker-Report-2021.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">at odds with EU climate objectives<\/a><\/u> and <u><a href=\"https:\/\/www.climatebonds.net\/files\/files\/eu-gas-briefing-220221.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">a major source of greenhouse gas<\/a><\/u> emissions, companies succeeded in passing it off as a \u201ctransition fuel\u201d in the eyes of <u><a href=\"https:\/\/www.euractiv.com\/section\/energy-environment\/news\/natural-gas-is-a-caveat-in-energy-transition-eu-admits\/\" target=\"_blank\" rel=\"noopener noreferrer\">major EU politicians<\/a><\/u>,<\/b> like the President of the EU Parliament Environment Commission <u><a href=\"https:\/\/www.euractiv.com\/section\/energy-environment\/interview\/mep-canfin-the-french-hard-line-on-nuclear-is-a-dead-end\/\" target=\"_blank\" rel=\"noopener noreferrer\">Pascal Canfin<\/a><\/u> and <u><a href=\"https:\/\/www.euractiv.com\/wp-content\/uploads\/sites\/2\/2021\/04\/2021-04-13-Letter-Taxonomy-Regulation-and-Delegated-Act.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">many MEPs<\/a><\/u>.<\/p>\n<p align=\"justify\"><b>The EU Commission largely seems to have incorporated this dangerous argument<\/b>. Its latest <u><a href=\"https:\/\/ec.europa.eu\/commission\/presscorner\/detail\/en\/qanda_21_1805\" target=\"_blank\" rel=\"noopener noreferrer\">Q&amp;A<\/a><\/u> explains that its future delegated act \u201cwill cover natural gas and related technologies as transitional activity in as far as they fall within the limits of the EU Taxonomy Regulation\u201d and that it will also \u201cconsider specific legislation covering the gas activities that contribute to reduce greenhouse gas emissions but cannot be covered within the EU Taxonomy as they do not meet the screening criteria\u201d.<\/p>\n<p align=\"justify\"><b>One could even say that fossil gas is already included in the EU Taxonomy due to insufficiently strict criteria on hydrogen manufacture and the blending of \u201clow carbon gases\u201d<\/b>. The thresholds for hydrogen manufacture have been reviewed to accommodate <u><a href=\"https:\/\/www.euractiv.com\/section\/energy-environment\/news\/industry-coalition-calls-for-hydrogen-blending-into-gas\/\" target=\"_blank\" rel=\"noopener noreferrer\">energy companies\u2019 demands<\/a><\/u>, making it easier for hydrogen to be manufactured using natural gas with carbon capture and storage (CCS) or grid energy coming from non-renewable sources. Similarly, the criteria adopted for transmission and distribution networks allow for the inclusion of any infrastructure that \u201cenables the increase of the blend of hydrogen or other low carbon gasses in the gas system\u201d without establishing any threshold for this blending, therefore facilitating the financing of infrastructures that will predominantly transport fossil gas.<\/p>\n<p align=\"justify\"><b>Fossil gas lobbying efforts largely benefit from the support of several <u><a href=\"https:\/\/www.euractiv.com\/section\/energy-environment\/news\/exclusive-eight-eu-states-back-natural-gas-in-net-zero-transition\/\" target=\"_blank\" rel=\"noopener noreferrer\">EU member states<\/a><\/u> that bet on it to replace their current coal power fleets <\/b>\u2013 notably <u><a href=\"https:\/\/www.euractiv.com\/section\/politics\/short_news\/slovakia-czechia-call-on-commission-to-postpone-climate-taxonomy-proposal\/\" target=\"_blank\" rel=\"noopener noreferrer\">Slovakia, Czechia,<\/a><\/u> Bulgaria, Romania, Poland, Malta, Greece and <u><a href=\"https:\/\/euobserver.com\/opinion\/151591\" target=\"_blank\" rel=\"noopener noreferrer\">Hungary<\/a><\/u> \u2013. <u><a href=\"https:\/\/twitter.com\/BasEickhout\/status\/1369982286104563714?ref_src=twsrc%5Etfw%7Ctwcamp%5Etweetembed%7Ctwterm%5E1369982286104563714%7Ctwgr%5E%7Ctwcon%5Es1_&amp;ref_url=https%3A%2F%2Fwww.euractiv.com%2Fsection%2Fenergy-environment%2Fnews%2Fleak-eu-considers-expanding-role-of-gas-in-green-finance%2F\" target=\"_blank\" rel=\"noopener noreferrer\">Opponents<\/a><\/u> to the inclusion of gas \u2013 including Austria, Denmark and Spain \u2013 struggled as <b>the inclusion of gas could have been used by eastern countries as a bargaining ship to let nuclear in<\/b>, thus driving strong nuclear advocates \u2013 like France or Norway \u2013 to support gas inclusion too.<\/p>\n<p align=\"justify\"><b style=\"color: #59bc6d;\">Nuclear advocates pushing harder than ever<br \/>\n<\/b><\/p>\n<p align=\"justify\"><b>Bowing to <u><a href=\"https:\/\/www.euractiv.com\/section\/energy-environment\/news\/nuclear-faces-a-lot-of-uncertainty-as-eu-green-evaluation-looms\/\" target=\"_blank\" rel=\"noopener noreferrer\">pressure<\/a><\/u> from pro-nuclear Member states, the Commission commissioned its Joint Research Centre (JRC) to draft yet another <u><a href=\"https:\/\/ec.europa.eu\/info\/sites\/info\/files\/business_economy_euro\/banking_and_finance\/documents\/210329-jrc-report-nuclear-energy-assessment_en.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">technical report<\/a><\/u> in 2020<\/b>. This report is currently being reviewed by two sets of experts, the \u2013 notably pro-nuclear &#8211; <u><a href=\"https:\/\/ec.europa.eu\/energy\/topics\/nuclear-energy\/radiation-protection\/scientific-seminars-and-publications\/group-experts_en\" target=\"_blank\" rel=\"noopener noreferrer\">Group of Experts<\/a><\/u> on radiation protection and waste management under Article 31 of the Euratom Treaty and the <u><a href=\"https:\/\/ec.europa.eu\/health\/scientific_committees\/scheer_en\" target=\"_blank\" rel=\"noopener noreferrer\">Scientific Committee <\/a><\/u>on Health, Environmental and Emerging Risks on environmental impacts (Sheer), and will inform the Commission&rsquo;s decision and content of the delegated act to come.<\/p>\n<p align=\"justify\">Despite scientific evidence and the very meaning of the \u201cdo not significantly harm\u201d principle pointing to the contrary (3), the JRC found no reason to exclude nuclear. This conclusion should not be surprising: <b>the JRC has structural links with the Euratom Treaty, relations with the nuclear industry and pro-nuclear views were previously expressed publicly by its members<\/b> (4). It notably led France to call on the delegated acts to be postponed until nuclear was included.<\/p>\n<p align=\"justify\">In that context, the Commission\u2019s statement that nuclear will be integrated in the complementary delegated acts was misinterpreted by nuclear advocates as an early win (5).<\/p>\n<p align=\"justify\"><b style=\"color: #59bc6d;\">Last chance to save the EU Taxonomy<br \/>\n<\/b><\/p>\n<p align=\"justify\">In an <u><a href=\"https:\/\/www.ft.com\/content\/a608ead1-790d-4587-8e77-9211066a0a03\" target=\"_blank\" rel=\"noopener noreferrer\">opinion piece<\/a><\/u> published hours before the Commission\u2019s announcements, the Financial Times\u2019 editorial board warned that to reach the Paris Agreement goals \u201cnew investment in fossil fuels such as gas will be all but impossible\u201d and that if the EU \u201cends up with a system that allows the greenwashing it is supposed to prevent, the consequences will be felt well beyond the bloc itself\u201d.<\/p>\n<p align=\"justify\">The Commission\u2019s decision to go ahead with deeply <u><a href=\"https:\/\/www.wwf.eu\/?uNewsID=3106966\" target=\"_blank\" rel=\"noopener noreferrer\">flawed bioenergy and forestry criteria<\/a><\/u> and to open the door to fossil gas and nuclear came as the last blow to an EU Sustainable Taxonomy that was already in poor shape. If adopted, the delegated acts would turn this key part of the EU sustainable finance strategy into a tool for greenwashing.<\/p>\n<p align=\"justify\">When it comes to energy, Europe\u2019s future lies with renewables (6). <b>It is up to the European Parliament and Council to reject the European Commission\u2019s proposal and oppose any future acts that would allow for fossil gas or nuclear to be included in the taxonomy framework<\/b>.<\/p>\n<p align=\"justify\"><b>Members of the EU Parliament and Council will also have to watch out for other \u201ctransitional activities\u201d <\/b>that the Commission will propose to include later on. The inclusion of such activities is a direct response to financial institutions\u2019 demands for a \u201c50 shades of green\u201d (7) approach that negates the fact that some activities are incompatible with climate objectives and aims at branding funding to unsustainable activities as compatible with the EU transition.<\/p>\n<p align=\"justify\"><b style=\"color: #8ac56b;\">Of course, it is doubtful that the Council members will step in to block a compromise that suits most of them. It will most likely be left to the Members of the European Parliament to step up and take their responsibility to avoid seeing the EU Sustainable Finance Strategy becomes a recipe for greenwashing that will jeopardize the EU transition and <u><a style=\"color: #8ac56b;\" href=\"https:\/\/www.ft.com\/content\/cddd464f-9a37-41a0-8f35-62d98fa0cca0?desktop=true&amp;segmentId=7c8f09b9-9b61-4fbb-9430-9208a9e233c8#myft:notification:daily-email:content\" target=\"_blank\" rel=\"noopener noreferrer\">set an example<\/a><\/u> not to be followed. <\/b><\/p>\n<\/div><div class=\"fusion-clearfix\"><\/div><\/div><\/div><\/div><\/div><div class=\"fusion-fullwidth fullwidth-box fusion-builder-row-2 nonhundred-percent-fullwidth non-hundred-percent-height-scrolling\" style=\"--awb-border-radius-top-left:0px;--awb-border-radius-top-right:0px;--awb-border-radius-bottom-right:0px;--awb-border-radius-bottom-left:0px;--awb-flex-wrap:wrap;\" ><div class=\"fusion-builder-row fusion-row\"><div class=\"fusion-layout-column fusion_builder_column fusion-builder-column-1 fusion_builder_column_1_1 1_1 fusion-one-full fusion-column-first fusion-column-last\" style=\"--awb-padding-top:10px;--awb-padding-right:10px;--awb-padding-left:10px;--awb-overflow:hidden;--awb-bg-size:cover;--awb-border-color:#ffffff;--awb-border-top:1px;--awb-border-right:1px;--awb-border-bottom:1px;--awb-border-left:1px;--awb-border-style:solid;--awb-border-radius:10px 10px 10px 10px;\"><div class=\"fusion-column-wrapper fusion-column-has-shadow fusion-flex-column-wrapper-legacy\"><div class=\"fusion-text fusion-text-2\"><div>\n<p><b style=\"color: var(--body_typography-color); font-family: var(--body_typography-font-family); font-size: var(--body_typography-font-size); font-style: var(--body_typography-font-style,normal); letter-spacing: var(--body_typography-letter-spacing);\"><span style=\"color: #59bc6d;\"><u><span style=\"color: #e5e3e3;\">Notes:<\/span><\/u><\/span><\/b><\/p>\n<\/div>\n<p align=\"justify\">1.
